شروط والأحكام
1.1 شروط الاستخدام
·
إن
الموقع/التطبيق الخاص بمؤسسة إستند للخدمات الطلابية والتي يشار إليها ("الموقع/التطبيق
إستند") لتلبية احتياجات الأفراد والمؤسسات ("مكاتب الخدمات العامة
والطلابية الخ") والشركات، وما فيه من خدمات أخرى متشعبة منه متاح
لاستخدامك الشخصي، ويخضع دخولك واستخدامك لهذا الموقع لبنود وشروط الاستخدام
وللأنظمة المعمول بها في المملكة، وكذلك يعد وصولك ودخولك إلى الموقع وخدماته
موافقة دون قيد أو شرط على بنود وشروط الاستخدام، سواءً كنت مستخدماً مسجلاً أم
لا، وتسري هذه الموافقة اعتباراً من تاريخ أول استخدام لك لهذا الموقع
يصبح أي تعديل لهذه البنود والشروط نافذاً فور إعلانه، ما لم يُبين
خلاف ذلك، ويعني استمرارك في استخدام هذا الموقع بعد إعلان أي تعديل قبول تام لذلك
التعديل.
1.2 القيود على الاستخدام للموقع/للتطبيق استند

وتتضمن هذه
الضوابط والشروط اتفاق رسمي بين موقع/تطبيق استند ومستخدمي التطبيق ومزودي الخدمة.
وتُحكم شروط المستخدم هذه استخدامكم لموقع/لتطبيق استند والذي هو عبارة عن منصة
إلكترونية تجمع بين مقدمي خدمة البحوث الطلابية وبنك التسليف والتأمينات
الاجتماعية والخدمات الالكترونية للدوائر الحكومية وبين العملاء المستخدمين
للتطبيق, حيث يُسمح الموقع/التطبيق استند لمقدمي الخدمة للتواصل مع عملاء
الموقع/التطبيق استند وأيضاً تقديم الخدمات لعملاء الموقع/التطبيق استند وقفاً لما
يتيحه الموقع/التطبيق استند.
·
إن اي
استخدام من قبل العميل أو مزود الخدمة للخدمات التي يوفرها موقع/تطبيق استند
خدمة يٌعد موافقة من العميل أو مزود الخدمة على هذا العقد وأحكامه وتبعاً
لذلك يجب عليك عدم استخدام الموقع/التطبيق في حال لم تكن موافقاً على الأحكام
والشروط الواردة في هذا الاتفاقية.
·
يحتفظ
موقع/تطبيق استند بحق تعديل او تغيير هذه الأحكام والشروط دون إخطار مسبق، ويكون
من مسؤولية العميل ومزود الخدمة عند الاستخدام لموقع/تطبيق استند مراجعة ضوابط
وشروط الاستخدام بشكل دوري لمعرفة التحديثات التي تطرأ على هذه الأحكام
والشروط، من خلال زيارة الموقع الرسمي عبر الرابط (https://estaned.com/)،
كما نأمل مراجعة سياسة الخصوصية لدينا لمعرفة المزيد حول كيفية
استخدام تطبيق إستند للمعلومات التي تقدم لنا من قبل مستخدمي التطبيق
.
وقد تنطبق بعض الشروط التكميلية على خدمات معينة، كالسياسات الخاصة
بحدث أو نشاط أو حملة ترويجية معينة، وسيتم الإفصاح لك عن هذه الشروط التكميلية
المتعلقة بالخدمات المقدمة. تُضاف الشروط التكميلية إلى الشروط لأغراض الخدمات
المقدمة كما وتعتبر جزءاً منها. وتسود الشروط التكميلية على هذه الشروط في حالة
التعارض فيما يتعلق بالخدمات المقدمة.
1.3 التزامات العميل/مقدم الخدمة
أ.
أنك لست
منافساً لموقع/تطبيق استند، كما أنك لا تقدم اي منتج منافس للخدمات المقدمة من
موقع/تطبيق استند .
ب.
لن تنسخ أو
توزع التطبيق أو المحتويات الأخرىدون الحصول على إذن كتابي من موقع/تطبيق استند.
ج.
سوف تستخدم
الخدمة أو التطبيق لأغراض مشروعة فقط، ولن تستخدم الخدمات لإرسال أو تخزين أي مواد
غير قانونية أو بهدف الاحتيال.
د.
لن تقوم
بتكرار تراخيص من الباطن, أو إصدار,أو نشر ,أو نقل, أو توزيع, أو تنفيذ, أو عرض,
أو بيع, أو إعادة تصنيف خدمات تطبيق إستند , والا فإنك تكون قد نقلت الخدمة أو
قمت باستغلالها تجارياً, باستثناء ما يسمح به بموجب هذا العقد
ه.
لن تستخدم
الخدمة أو التطبيق للتسبب بإيذاء أو مضايقة أو إزعاج أحد ما .
و.
التسجيل
للحصول على حساب شخصي فعّال لخدمات المستخدم والمحافظة عليه، لم يسبق أن تم تعطيل
استخدام الخدمات لموقع/لتطبيق استند اومنعك من استخدامها في اي وقت من الأوقات.
ز. سوف تقدم لنا كافة الدلائل التي تثبت هويتك/معلومات شخصية صحيحة وكاملة إلى موقع/تطبيق استند (كاسمك وعنوانك ورقم هاتفك الجوال وعمرك) وتحديثها بشكل دوري، وفقاً لتقدير موقع/تطبيق استند.
-يلتزم مقدم الخدمة في تطبيق /موقع استند بتنفيذ الطلب للعميل بشكل الكامل والمطلوب
-يلزم مقدم الخدمة بالتاكد من استلام العميل للطلب بنجاح قبل ان يضع إنها الطلب ويتم ذلك من خلال الدردشة في تطبيق/موقعاستند
-يلتزم مقدم الخدمة في تطبيق/موقع استند بإنهاء الطلب في الوقت المحدد الذي ارفقه في العرض
-يلتزم مقدم الخدمة في تطبيق/موقع استند بعدم ارسال العروض لخدمة لا يستطيع القيام بها بجودة عاليه
-في حال لم يستطيع مقدم الخدمة في تطبيق/موقع استند القيام بتنفيذ الطلب للعميل يضع الغاء الطلب لا إنهاء الطلب
-يلتزم مقدم الخدمة في تطبيق/موقع استند بإن يتم التواصل مع العميل داخل تطبيق /موقع استند فقط-يلتزم العميل ومقدم الخدمة بعدم رفع دعوى قضائيةعلى تطبيق إستند -يلتزم مقدم الخدمة في تطبيق/موقع استند بعدم بالتواصل مع العميل خارج تطبيق/موقع استند او ابلاغ العميل بتواصل معه فياحدى مواقع التواصل الاجتماعي
-يلجأ مقدم الخدمة في تطبيق/موقع استند للواتساب والايميل للضرورة القصوى (عند ارسال بعض الملفات التي لاتدعمها الدردشة في تطبيق/موقع استند )
-سوف يتم إيقاف حساب مقدم الخدمة لمدة اقصاها 5 أيام في حال لم يلتزم بالتزامات مقدم الخدمه في تطبيق/موقع استند ويعتبر الانذار الأول
-الإنذار الثاني لمقدم الخدمه في تطبيق/موقع استند يتم إيقاف حسابه نهائيا في حال قام بتكرار اختراق التزامات مقدم الخدمة
-في حال طلب العميل خدمة من تطبيق /موقع استند ولم يقم بتوفيرالمستندات المطلوبةللخدمةيحق لتطبيق/موقع استند اخذمستحقات الخدمة
-يحق لتطبيق /موقع استند اخذ مستحقات الخدمة في حال عدم تواصل العميل مع مقدم لاتمام طلبه خلال 24ساعة
-يحق للعميل طلب تعديل على طلبه في تطبيق/موقع استند طلبه تعديلاً بسيطاً قبل يتم إنهاء الطلب
" الإقرار
بجميع الأنشطة التي تُجرى باسم حساب العميل/مقدم الخدمة والحفاظ على أمان وسرية
اسم المستخدم وكلمة المرور الخاصة بحساب العميل/مقدم الخدمة طوال الوقت. ولا يحق
لك امتلاك أكثر من حساب ما لم تسمح لك موقع/تطبيق استند كتابةً بخلاف ذلك.
ط.
لن تستخدم
المعلومات، أو المحتوى أو أي بيانات تصل إليها أو تحصل عليها من خلال خدمات
موقع/تطبيق استند خدمة في أي غرض آخر إلا للاستعمال الشخصي وسوف تستخدم
التطبيق والخدمة حصراً للأغراض الخاصة بك ولن تبيعها لأي طرف ثالث (على سبيل
المثال لا الحصر تقديم أي خدمة إلى أي شخص آخر.(
ي.
الدفع مرة
واحدة صحيحة على الأقل (إما بالبطاقة ائتمانية أو شريك دفع مقبول). وتتعهد بتقديم
معلومات صحية وكاملة في حسابك الخاص والمحافظة على الحساب. في حال الإفصاح أو
الإدلاء بمعلومات غير صحيحة وكاملة أو كانت عملية الدفع بواسائل الدفع المذكورة
منتهية الصلاحية، إلى عدم إستطاعة العميل/مقدم الخدمة الوصول أو الحصول على
الخدمات أو الإستخدام أو الحجب من موقع/تطبيق استند لهذه الشروط والأحكام وفقاً
لتقدير موقع/تطبيق استند.
ك.
سوف تمتثل
لنظام مكافحة الجرائم المعلوماتية ولكافة القوانين والأنظمة
واللوائح والأعراف ذات العلاقة بالمملكة العربية السعودية.
إقرار بعدم الغاء الخدمة عند وصول مقدم الخدمة لتنفيذ الخدمة، وأن
أحقيتك في إلغاء الخدمة تكون محدودة بفترة(دقيقتان) بعد تقديم الطلب، وبأنه في حال
إلغاء الخدمة لأي سبب من الأسباب وبدون إبداء أسباب بعد فترة السماح بإلغاء الطلب،
فسيتم الحظر والحجب من الموقع/التطبيق نتيجة لإلغاء العملية.
2.1 متطلبات العميل/مقدم الخدمة وسلوكه
·
الإستفادة
من خدمات الموقع/التطبيق إستند يجب أن يتمتع بكامل الأهلية والقدرة على ممارسة
حقوقة والتزاماتة.
·
لا يحق
للعميل/مقدم الخدمة بتفويض استخدام الحساب الشخصي لأطراف خارجية،
·
الأشخاص في
سِن التمييز أو عديم التمييز (غير مؤهلين لإبرام عقود قانونية ) لعدم
الاسفادة للحصول على الخدمات المقدمة من موقع/تطبيق إستند ما لم يكونوا بصحبتك.
·
لا يجوز
للعميل/مقدم الخدمة التنازل عن الحساب أو نقل ملكيته إلى أي شخص أو كيان آخر.
·
بحظر على
العميل/مقدم الخدمة أن يتسبب (عند استخدامك لأي خدمة) في إلحاق الأذى أو الإزعاج
أو المضايقة أو الإضرار في الملكية، سواءً من العملاء/مقدمي الخدمات أو إلى أي
أطراف أخرى ذات علاقة.
يُطلب من العميل/ مقدم الخدمة تقديم بيانات الشخصية للإستفادة من
خدمات موقع/تطبيق إستند، وتوافق على أنه قد تُمنع للوصول/الأستفادة إلى خدمات
الموقع/التطبيق إستند أومن استخدام الموقع/التطبيق إذا ما رفضت تقديم
إثبات الشخصية.
2.2 الترخيص
تمنحك موقع/ تطبيق استند شريطة امتثالك بهذه الشروط، ترخيصاً محدوداً
غير حصري ولا يمكن ترخيصة من الباطن ولا يمكن نقلة إلى شخص آخر وهو قابل للإلغاء
وغير قابل للتحويل، وغير قابل للتنازل، وذلك للحصول على الخدمات و الاستخدام فقط
للغرض الشخصي، وليس للأغراض المنافسة او سرقة محتويات الموقع/التطبيق وفي حاله
إعادة نسخ الخدمات وبيعها لمنافس آخر، من أجل (سبيل المثال لا الحصر):
-
الوصول إلى
الموقع/التطبيق استند واستخدامها على جهازك الشخصي فيما يتعلق باستخدامك للخدمات
فقط؛
-
الوصول إلى
أي من المحتويات والمعلومات والمواد ذات الصلة التي قد يتم توفيرها من خلال
الخدمات واستخدامها، وفي جميع هذه الحالات يكون الاستخدام شخصي فقط وغير التجاري.
ويحتفظ تطبيق استند والمرخصون التابعون له بأي من الحقوق غير الممنوحة صراحة في
هذه الشروط.
-
عدم إتاحة
الخدمات أو تأجير، أو استئجار أو تخصيص أو إعادة بيع، أو توزيع أو ترخيص من
الباطن لهذه الخدمات إلى أي طرف ثالث.
-
عدم تعديل،
أو اجتزاء، أو ترجمة، أو تلخيص، أو إنشاء عمل فرعي يقوم على فك، أو تنفيذ خدمة
عكسية لتصميم موقع/تطبيق أو خلاف ذلك من تحديد أو محاولة تحديد أو محاولة الوصول
إلى شفرة المصدر أو التصميم الداخلي للخدمات أو أي نص، أو صور الوسائط المتعددة
(صور، صوتيات، ملفات فيديو)، أو البيانات أو غيرها من المعلومات التي يقدمها
موقع/تطبيق استند أوطرف ثالث من مقدمي الخدمة.
-
عدم حذف،
أو تغيير، أو غير ذلك من التعديل على أي حق من حقوق النشر أو غيرها من الإخطارات
الرسمية الواردة في الخدمات.
-
عدم تعمد
نقل، أو توزيع الخدمات، أو السماح بتحميل الخدمات للاستخدام بخلاف ما هو محدد هنا.
عدم الإدعاء بمنح الخدمات أو السماح بالوصول إليها لأي شخص غيرك.
2.3 حقوق الملكية
أ.
تُشرف
موقع/تطبيق استند بالمملكة على هذا الموقع فنياً، وتعد جميع حقوق الملكية الفكرية
وكافة الخدمات والمحتويات الموقع والمواد المتعلقة بها أو التي تظهر عليها من
معلومات ملكًا لموقع/لتطبيقى استند، وهي محمية بالكامل طبقا لأنظمة المملكة
العربية السعودية لحقوق النشر والعلامات التجارية وحُقوق الملكية الفِكرية.
ب.
ما لم ينص
على خلاف ذلك، لا يجوز بيع خدمات الموقع/التطبيق وموادها أو ترخيصها أو تأجيرها أو
تعديلها أو نسخها أو استنساخها أو إعادة طبعها أو تحميلها أو الإعلان عنها أو
نقلها أو توزيعها أو عرضها بصورة عَلنية أو تحريرها أو إنشاء أعمال مشتقة منها
للجمهور أو لأغراض تجارية، دون الحصول على الموافقة المُسبقة من إدارة إستند إلا
للأغراض العلمية والبحثية ونشر الوعي فيجوز الاقتباس بشرط الإشارة إلى الموقع.
ج.
يجب عليك
ألا تقوم بإعادة إنتاج أو السماح لأي شخص، لأي سبب من الأسباب، باستخدام أو إعادة
إنتاج الخدمات أو أي علامات تجارية أو غيرها من الأسماء التجارية التي تظهر في
الخدمات للموقع/للتطبيق.
د.
يمنع منعاً
باتاً أي تعدياً لأي من محتويات الموقع.
الرسومات والصور على هذه الموقع محمية بموجب حقوق النشر، ولا يجوز
استنساخها أو استغلالها بأية طريقة كانت، دون موافقة خَطِية مُسبقة من إدارة
إستند.
3.1 الأسعار
· تعتمد الاسعار الظاهرة على الموقع/التطبيق لكل خدمة قَبل الطلب، قد يختلف السعر بحسب نوع الخدمة ووقت انجازها وفترة إنجاز طلب الخِدمة وإتاحة مزودي الخدمة في الحالة المشار اليها بكلمة نشط.
. يتم احتساب نسبة 20٪ من كل خدمة يتم تقديمها من خلال تطبيق موقع /استند
. يلتزم مقدم الخدمة ان يقوم بتنفيذ الطلب بالشكل المطلوب من العميل
. لا يحق لمقدم الخدمة في تطبيق/موقع استند المطالبة بمستحقاته الماليه من مبلغ الخدمة التي لم يقوم بتنفيذها للعميل او في حال قام بالردعلى استفسارات العميل فقط
. لن يقوم تطبيق/موقع استند بتحويل المبلغ المستحق لمقدم الخدمة في حال لم يقم بتنفيذ الطلب بالشكل المطلوب من العميل
. يتم احتساب نسبة 20٪ من كل خدمة يتم تقديمها من خلال تطبيق موقع /استند
. يتم تحويل المستحقات المالية لمقدم الخدمة في حال وصول رصيد حسابه 100ريال في مدة اقصاها 60يوماً
قد تُطبق عليك الأسعار والرسوم البيانات والرسائل التي تستخدمها شبكة
الجوال التي تشترك فيها للحصول على الخدمات من جهاز يعمل لاسلكياً يتحمل
العميل/مزود الخدمة المسؤولية الأسعار والرسوم. ويتحمل العميل/مزود الخدمة مسؤولية
حيازة وتحديث المعدات أو الأجهزة المناسبة التي تكون ضرورية للوصول إلى خدمات
الموقع/التطبيق الخاص بإستند وأي تحديثات خاصة. ولا تُضمن موقع/تطبيق استند أن
تعمل الخدمات، أو أي جزء منها، على أي معدات أو أجهزة معينة. إضافة إلى ذلك، قد
تعاني بعض الخدمات من الأعطال والتأخيرات المتصلة في استخدام الإنترنت
والاتصالات اللاسلكية.
3.2 الدفع
·
يحتفظ
موقع/تطبيق استند لنفسه بالحق في إنشاء و/أو إلغاء و/أو مراجعة و/أو فرض الرسوم
الخاصة أوالجديدة على استخدام التطبيق أو الموقع أو كليهما في حال تغير اشتراطات
الخدمة التي يتم الحصول عليها أو جميعها من الجهات الرقابية والإشرافية بما ان
تنفيذ الخدمة من قبل مزودي الخدمة اصبح يأخذ وقتاً أطول في الإنجاز
الخدمة محل الطلب وفقًا لتقدير موقع/تطبيق استند المطلق.
·
ستبذل
موقع/تطبيق استند جهوداً معقولة لإخطارك بالرسوم التي قد تنطبق عليك شريطة أن
تتحمل المسؤولية عن الرسوم المتكبدة في حسابك بغض النظر عن درايتك بها أو بالمبالغ
الخاصة بهذا الحساب.
·
إذا قرر
تطبيق/موقع إستند فرض رسوم جديدة، فإنه سيتم إفادتك بذلك وسيتم السماح لك
بالاستمرار في العقد أو إنهائه ويمكن العثور على الأسعار التي يطبقها مقدمي خدمة
تطبيق إستند مقابل تقديم الخدمة على موقع الويب أو من خلال التطبيق.
·
يجوز موقع/تطبيق إستند تعديل أو تحديث الأسعار من وقت لآخر
·
يجوزموقع/تطبيق
استند من حين إلى آخر أن تزود بعض المستخدمين بالعروض والخصومات الترويجية التي قد
ينتج عنها مبالغ متفاوتة يتم دفعها للحصول على نفس الخدمة أو خدمات مماثلة أثناء
استخدام الموقع/التطبيق لاستند وتوافق من جانبك على ألا يكون لهذه العروض
والخصومات الترويجية- ما لم تُتاح لك أيضاً- علاقة للحصول على الخدمات أو الرسوم
المحتسبة عليك.
·
يتوجب عليك
دفع قيمة الخدمة المقدمة لك إلى مقدم الخدمة قبل تقديم الخدمة لك وتتحمل وحدك
مسؤولية دفع جميع الرسوم في موعدها. وإنك تقر بأن أي مبلغ يدُفع لا يمكن استرداده
في حال لم تقم بإلغاء الخدمة قبل (دقيقتان) من انجازها.
· تُقر وتوافق بأنه وبأي حال من الأحوال وفي حال تعطّل موقع/تطبيق استند أثناء عملية تقديم الخدمة لأي سبب سواءً كان السبب راجع إلى تقنيات موقع/تطبيق استند، أوإلى التجهيزات الخاصة بكم، فإنكم تلتزمون بدفع قيمة الأجرة الأساسية فقط لمقدمي الخدمة وهي المبلغ الظاهر في موقع/تطبيق استند لنوع الخدمة المطلوبة.
. يحق لتطبيق/موقع استند خصم رسوم وسائل الدفع الالكتروني من المبلغ المدفوع من قبل العميل للخدمة في حال تم استرداد المبلغ للعميل
تقر وتوافق بأن تلتزم بالأمانة دائماً فِيما يتعلق بقِيمة وحقيقة
الخدمات المقدمة لك، وتوافق بأنه في حال اكتشاف أي تحايل أو تلاعب أو مُخادعة فإن
العمل/مقدمي الخدمة سيكون عرضة لإيقافك عن استخدام موقع/تطبيق استند ،
بالإضافة إلى حق موقع/تطبيق استند في المطالبة بالتعويضات عن كافة الأضرار
التي نتجت أو ستنتج نتيجة لهذا التحايل والتلاعب.
3.3 التعويض
بالموافقة على شروط المستخدم وأحكام استخدام الموقع/التطبيق، فإنك
توافق على الدِفاع عن الموقع/التطبيق والجهات الإشرافية والرقابية على تقديم
الخدمات والجهات المانحة للترخيص للموقع/للتطبيق وكلن مسؤول من مسؤولية ومديري
استند وغيرهم من العملاء ومقدمي الخدمات والموظفين والمحامين والوكلاء وعدم إلحاق
الضرر بهم وإبراء ذمتهم من أي مطالبات وتكاليف وأضرار وخسائر ومسؤوليات ومصروفات
(بما في ذلك أتعاب وتكاليف المحاماة) التى تنشأ عن/ترتبط بما يلي:
-
انتهاك أو
مخالف لأي شرط من شروط الاستخدام والأحكام أولأي قانون أونظام أولوائح ذات
العلاقة، سواءً أُشير إليها في شروط الاستخدام والأحكام ام لم تُشر.
-
انتهاكك
لأي حق من حقوق تخص الغير، على سبيل المثال لا الحصر مُقدمي خدمة صيانة التقنية الذين
يعملون على تحديث خدمات موقع/تطبيق استند.
-
استخدام أو
إساءة استخدام الموقع/التطبيق أو الخدمة يتحمل العميل/مقدم الخدمة المسؤولية
القانونية كاملة.
-
المعلومات
والتوصيات والخدمات أو أي من التي قُدِمت للعميل و/أو مقدم الخدمة على
الموقع/التطبيق/الخدمة لغرض المعلومات العامة فقط ولا تمثل أي نصيحة.
-
سيحتفظ
موقع/تطبيق استند قدر الإمكان على صحة وتحديث الموقع/التطبيق ومحتوياته، وكذلك
ستعمل استند جاهدةً على حماية بيانات ومعلومات عملائها الشخصية وكلمات المرور
الخاصة بك.
-
لا تتحمل
موقع/تطبيق استند المسؤولية عن أي أضرار تنتج عن استخدام (أو عدم القدرة على
استخدام) الموقع/التطبيق، بما في ذلك الأضرار التي تسببها البرامج الضارة أو
الفيروسات، كما لا تتحمل مسؤولية عدم صحة
أو عدم اكتمال المعلومات أو موقع/تطبيق، ما لم يكن هذا الضرر ناتج عن سوء سلوك
معتمد أوعن إهمال جسيم من جانب موقع/تطبيق استند.
تقع مسؤولية جودة خدمة الخدمة المُقدمة على الموقع و/أو التطبيق
و/أوالخدمة بأكملها على عاتق مُقدم الخدمة الذي يُقدم لك في النهاية خدمة
الكترونية سلسلة تتوائم مع توجه حكومة المملكة العربية السعودية وإماناً مِنا
بروية 2030 في تقديم أفضل وأميز الخدمات الكترونياً المساندة لكافة فئات المجتمع
بكل سهولة ويسر وبموثوقية وامان:
-
لا يُقبل
موقع/تطبيق استند تحت أدنى مسؤولية تتعلق بالخدمات المزودة/المُقدمة من خلال
الموقع/التطبيق من مقدمي الخِدمة أو التي تنشأ عن الموقع/التطبيق، موقع/تطبيق
استند لا تُقبل أي مسؤولية عن الأفعال أو التصرفات أو السلوك أو الإهمال، أو جميع
ما سبق، من جانب مقدم/مزود خدمة العملاء.
-
الشكاوى
المُقدمة سواءً من العميل/مقدم الحدمة بشأن خدمات الموقع/التطبيق الضغط على ايقونة
الشكاوى.
-
التقِييم
من قِبل عُملاء استند بتقدير جيد مرتين خلال الشهر الواحد يُبَلَغَ مقدم الخدمة
كتابياً بإنهاء خدماته فورأ بناءً على التقييمات المُقدمة من العملاء.
يوافق العميل/مزود الخدمة على تعويض وإبراء ذمة موقع/تطبيق استند
مسؤوليها ومديريها وموظفيها ووكلائها عن جميع المطالبات والخسائر والمسؤوليات
والنفقات (بما فيها أتعاب المحاماة) التي تنشأ عن التالي:

استخدامك
أو الإستفادة من الخدمات التي تحصل عليها من خلال استخدام الموقع/التطبيق لاستند؛
-
خرقك أو
انتهاكك لأي من هذه الشروط؛ أو
-
استخدام
موقع/تطبيق استند لمحتوى المستخدم الخاص بك؛
-
انتهاكك
لحقوق أي من الأطراف الآخرى بمن فيهم مقدمي الخدمات.
-
يقر
العميل/مقدم الخدمة بعدم اتخاذ أي إجراءات ضد إستند أو موظفيها أو المسؤولين عن
إدارة خدمات الموقع أو صيانتها أو تحديثها أو تقديمها، وإعفائها من جميع
الالتزامات والمسؤوليات والتعويضات الناشئة عن استخدام الخدمات سواء أكان الإخلال
من جانبه ببنود وشروط الاستخدام، أو أي من الأنظمة السارية سواء في المملكة
العربية السعودية أو السياسات
الداخلية أوالمكان الذي يقيم فيه، أو لغير ذلك.
4.1 المرجعية القضائية
يخضع المستخدم للأنظمة القضائية المطبقة بالمملكة العربية السعودية.
4.1 التزام
للقوانين
·
كشرط من
شروط التسجيل على موقع/تطبيق استند فإنك توافق على أنه ستمتثل لجميع القوانين
والأنظمة والمراسيم والقواعد واللوائح والأوامر والتراخيص والتصاريح والأحكام
والقرارات أو أي متطلبات الأخرى لأي سلطة حكومية لها سلطة قضائية على العميل/مقدم
الخدمة، سواءً أكانت تلك القوانين والأنظمة والقواعد واللوائح والتراخيص والتصاريح
سارية أو دخلت حيز التنفيذ لاحقًا خلال
فترة التسجيل في الموقع/التطبيق.
·
يُقر
ويتعهد العميل/مقدم الخدمة بعدم الإستخدام الخدمات/البيانات وفقًا لسياسات
الخصوصية الخاصة بمؤسسة إستند للخدمات الطلابية، وجميع القوانين المعمول بها
والسياسات الداخلية أو استخدامها بطرق آخرى.
·
يوافق
العميل/مزود الخدمة بموجبه على تعويض مؤسسة إستند للخدمات الطلابية وحمايتها من أي
أضرار وخسائر ومسؤوليات وتسويات ونفقات (بما في ذلك على سبيل المثال لا الحصر
التكاليف وأتعاب المحاماة المناسبة) فيما يتعلق بأي مطالبة أو إجراء ينشأ عن
انتهاك مزعوم لما سبق.
·
على الرغم
من أن الموقع/التطبيق استند ليست ملزمة بمراقبة المحتوى المُقدم من قِبل
العميل/مزود الخدمة أو استخدام العميل/مزود الخدمة للخدمات، إلا أن الموقع/التطبيق
استند قد تفعل ذلك وقد تزيل أي محتوى من هذا القبيل أو تحظر أي استخدام للخدمات
التي يُعتقد أنها (أو يُزعم أنها) تنتهك أي ما سبق.
·
يوافق
العميل/مقدم الخدمة على الإلتزام لجميع القوانين والأنظمة ذات العلاقة عند استخدام
الخدمات، ولا يجوز للعميل/مقدم الخدمة الاستخدام إلا لأغراض قانونية (على سبيل
المثال لا الحصر، عدم نقل مواد غير قانونية أو خطرة).
4.3
إخلاء المسؤولية
الخدمات الإلكترونية التي التي يتم الحصول عليها من الموقع أو من خلاله، هي خدمات ومعلومات يتم توفيرها "كما هي" و"حسب توفرها"، وبهذا يُقر المستخدم سواءً كان عميلاً أم مقدم خدمة بعلمه الكامل النافي للجهالة لذا تُخلي موقع/تطبيق استند مسؤوليتها عن جميع الأنشطة والإقرارات والتعهدات صريحة كانت أم ضمنية أم تشريعية والتي لم يُنص عليها صراحة في هذه الشروط بما فيها الإقرارات الضمنية الخاصة بقابلية الخدمات المقدمة والملائمة لغرض معين وعدم المخالفة. إضافة إلى ذلك، لا تقدم موقع/تطبيق استند أي إقرارات أو تعهدات أو ضمانات بخصوص موثوقية أو دقة مواعيد أو جودة أو ملاءمة أو توافر الخدمات أو تعطل الخطوط أو الأنظمة أو كان ذلك ناتجاً عن الإخلال بهذه الاتفاقية أو الضمانات أو الإهمال أو المسؤولية الخاصة بالخدمات أو المعلومات. ولا تضمن موقع/تطبيق استند جودة مقدم الخدمة الخارجي أو ملاءمتهم أو سلامتهم أو قدرتهم. توافق من جانبك على أن المخاطر الكاملة التي تنشأ عن استخدامك للخدمات أو أي من الخدمات أو السلع المطلوبة فيما يتعلق بهذا الاستخدام تبقى متعلقة بك وحدك إلى الحد الأقصى المسموح به بموجب القانون المعمول به .ان تطبيق/موقع استند ليس مسؤلاً عن اي مضايقات بين مقدم الخدمة والعميل
4.4 حدود المسؤولية
لن تكون موقع/تطبيق استند مسؤولة عن الأضرار أوالأضرار المباشرة أو
غير المباشرة أو الخاصة أو العرضية أوالتحذيرية أو الجزائية أو التبعية أو
الناتجة، أو الخسائر أو المصروفات أي منها أو الخدمات المطلوبة أثناء استخدام هذه الموقع/التطبيق
استند أو بخصوص عدم انقطاع الخدمات أو خلوها من الأخطاء أوفشل في الأداء، أو الخطأ
أو الإهمال أو الانقطاع أو التعطل أو التأخير في التشغيل أو البث أو بسبب فيروسات
الجهاز(المحمول أولامكتبي أواللابتوب) أو مشاكل الدخول على شبكة الإنترنت بما فيها
خسارة أوفقدان البيانات أو الضرر اللاحق بالمعلومات والبيانات حتى وإن أُبلغت
موقع/تطبيق استند باحتمالية حدوث تلك الأضرار. ولن تكون موقع/تطبيق استند مسؤولة
عن أي أضرار أو مسؤوليات أو خسائر تنشأ عن:

استخدامك
للخدمات أو اعتمادك عليها أو عدم قدرتك على الوصول إلى الخدمات أو استخدامها؛
أي معاملة تجارية أو علاقة بينك وبين أي مقدم الخدمات، حتى وإن تم
إبلاغ موقع/تطبيق استند باحتمالية حدوث تلك الأضرار. ولن تكون موقع/تطبيق استند
مسؤولة عن التأخير أو الإخلال بالأداء الناشئ عن أسباب تقع خارج سيطرة موقع/تطبيق
استند المعقولة.
5.1
الحماية من الفيروسات
تبذل إستند كافة الجهود لفحص واختبار محتويات الموقع، وعلى المستخدم
الالتزام بتشغيل برامج مضادات الفيروسات في جميع المواد التي يقوم بتنزيلها من
الموقع، ولا تكون لإستند أدنى مسؤولية عن أي خسائر أو انقطاع أو تلفيات في بيانات
وأجهزة المستخدم، عند استخدام الموقع، أو المواد الواردة منها.

التنازل عن المطالبات

إستند والخدمات والمعلومات والمواد والوظائف المتاحة به، أو التي يمكن الوصول
إليها من خلاله تُوفر للمستخدم "كما هي" و"كما هي متاحة" دون
أي إقرار أو وعود أو ضمانات من أي نوع ولا يمكن لإستند أن تضمن أو تتحمل المسؤولية
عن أي انقطاعات أو أخطاء أو تجاوزات قد تنشأ عن استخدام هذا الموقع أو محتوياته أو
أي موقع يرتبط به، سواء كان ذلك بعلمها أو بدون علمها.
لا يكون للمستخدم الحق في ملكية أي اتصالات أو معلومات قد يقوم
بإرسالها من خلال خدمات هذا الموقع أو حق ضمان سريتها كما أن أي استخدام أو
استخدام تفاعلي تتضمنه هذه الخدمات لا تضمن للمستخدم أي حقوق أو تراخيص أو أية
امتيازات من أي نوع.
5.3 معايير التعليقات والمشاركة الإلكترونية
تخضع كل التعليقات التي تضاف في قنوات المشاركة الإلكترونية لعملية
فلترة بهدف التأكد من التزام صاحب التعليق بمعايير وضوابط نشر التعليقات، ومن حق
إستند عدم نشر أية تعليقات تراها غير مناسبة للنشر، علماً بأن معايير نشر
التعليقات تشمل ما يلي:

يجب على
صاحب التعليق أن يلتزم بالآداب العامة وأنظمة المملكة العربية السعودية، وأن يتجنب
استخدام أية عبارات غير مناسبة أو ألفاظ خادشة للحياء.
ب.
أن يكون
التعليق منصباً/مرتبطاً على الموضوع المطروح للنقاش وألا يبتعد عن ذلك بأي شكل من
الأشكال عنه.
ج.
تجنب
الوقوع في أية انتقادات شخصية لا تهدف إلى إثراء الفكرة المطروحة.
د.
الابتعاد
عن النعرات/الإختلافات الطائفية وتجنب الوقوع في أية موضوعات عنصرية أو خلافات
مذهبية.
تجنب كتابة أي معلومات شخصية على سبيل المثال أي معلومات خاصة

h. Acknowledge all
activities that occur in the name of the customer/service provider account and
always maintain the security and confidentiality of the username and password
for the customer/service provider account. You may not have more than one
account unless otherwise permitted by the Estand Site/App in writing.
i.
You will not use the information, content, or any data
you access or obtain through the Estand website/application services for any
other purpose except personal use. You will use the Application and the Service
exclusively for your own purposes and will not sell them to any third party
(including without limitation providing any service to anyone else).
j.
Make at least one valid payment (either via credit
card or accepted payment partner). You undertake to provide correct and
complete information in your account and to maintain the account. In the event
that incorrect and incomplete information is disclosed or provided, or the

Customer/Service Provider will not be able to access or obtain the Services or
use or block the Ostend Website/App in accordance with these Terms and

will also work hard to protect the data and personal information of its
customers and your passwords.

The Estand site/app is not responsible for any damages
resulting from the use of (or inability to use) the site/app, including damage
caused by malware or viruses, nor is it responsible for incorrect or incomplete
information or the website/application. Application, unless such damage results
from authorized misconduct or gross negligence on the part of Estand site/App.

all obligations, responsibilities and compensation arising from the use of the
services, whether breach of the terms and conditions of use, or any of the
